DMCA Policy for Pickled Jalapenos

Pickled Jalapenos respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond promptly to claims of copyright infringement committed using the Pickled Jalapenos website or other online services, provided such claims are reported to our Designated Copyright Agent identified below.

It is our policy to remove any content that infringes upon the copyright of any person under U.S. copyright law upon receipt of a compliant DMCA takedown notice. If you believe your copyrighted work has been infringed on our site, please provide our Copyright Agent with a written DMCA Takedown Notice containing the following information.

Filing a DMCA Takedown Notice

  1. **Identification of the copyrighted work:** A description of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  2. **Identification of the infringing material:** Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Pickled Jalapenos to locate the material (e.g., the specific URL(s) of the infringing page(s) on our site).
  3. **Contact information of the complaining party:** Your full legal name, mailing address, telephone number, and email address.
  4. **A statement of good faith belief:** A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. **A statement of accuracy:** A statement that the information in the notification is accurate, and under penalty of perjury, that you are the owner, or an agent authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed.
  6. **An electronic or physical signature:** The electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.

Once a complete and valid DMCA Takedown Notice is received, it is our policy to remove the identified infringing material. We will also notify the user who posted the material of the complaint and provide them with an opportunity to file a counter-notification.

Filing a DMCA Counter-Notification

If you believe your material has been removed or disabled by mistake or misidentification, you may submit a Counter-Notification to our Designated Copyright Agent. A valid Counter-Notification must include the following information:

  • **Identification of the material:** Identification of the material that has been removed or to which access has been disabled and the location (URL) at which the material appeared before it was removed or disabled.
  • **A statement under penalty of perjury:** A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • **Your name, address, and telephone number:** Your full legal name, mailing address, and telephone number.
  • **Consent to jurisdiction:** A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Pickled Jalapenos may be found.
  • **Acceptance of service of process:** A statement that you will accept service of process from the person who provided the original DMCA Takedown Notice or an agent of such person.
  • **Your physical or electronic signature:** Your physical or electronic signature.

Upon receipt of a valid Counter-Notification, we will send a copy to the original complaining party. If the complaining party does not inform us within 10 business days that they have filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the material on Pickled Jalapenos, we may, at our sole discretion, replace the removed material or cease disabling access to it.
